Artisan Gourmet Wholesale Pty Ltd ("we", "us", "our") operates a wholesale food manufacturing and supply business and the website at [wholesale.tfk.com.au] (the "Website"). We are committed to protecting personal information and handling it in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

Our wholesale customers are generally businesses. We may still collect personal information about the individuals associated with those businesses, such as owners, directors, managers, and staff who deal with us. This policy applies to that personal information.

Contact and identity information: names, job titles, business email addresses, phone numbers, and business addresses of the individuals who deal with us on behalf of a wholesale customer or prospective customer.

Business and account information: business name, ABN or ACN, trading history, the products and volumes you are interested in or have ordered, and your delivery and account preferences.

Trade account and credit application information: where you apply for a credit account, we collect the information needed to assess the application. This may include business financial information, trade references, details of directors, partners, or proprietors, and, where an individual provides a personal guarantee, information about that individual.

Order and transaction information: orders placed, invoices, payment records, delivery records, and account correspondence.

Payment information: where payment is made by card through a payment link or invoice, card details are entered directly into our payment provider's secure systems and are not stored by us. We receive confirmation of payment and limited details such as the card type and last four digits. Where payment is made by electronic funds transfer, we receive the remittance details associated with the transfer.

Enquiry information: information you submit through enquiry or contact forms on the Website, including details of your business and your wholesale requirements.

Marketing preferences: your subscription status and engagement with our trade communications.

Technical and usage information: IP address, device and browser type, pages visited, referring URLs, and interactions with the Website, collected automatically through cookies and similar technologies (see section 8).

We do not generally collect sensitive information. If you provide such information to us, we will only use it for the purpose for which it was provided and as permitted by the Privacy Act.

3. How we collect personal information

We collect personal information directly from you when you:

  • submit an enquiry or contact form on the Website;
  • apply for a wholesale or credit account;
  • place orders with us by phone, email, or other means;
  • correspond with us about your account, orders, or products; and
  • subscribe to our trade updates or marketing communications.

In some cases, we may collect personal information from third parties, including credit reporting bodies, trade referees you nominate, your business's public records (such as ASIC or ABN records), and our delivery and logistics partners.

4. Why we collect, hold, use, and disclose personal information

We use personal information for the following purposes:

  • to respond to enquiries and provide quotes and product information;
  • to assess applications for wholesale and credit accounts, including assessing creditworthiness;
  • to set up, manage, and administer wholesale accounts;
  • to process, fulfil, and deliver orders, and to manage invoicing and payment;
  • to manage credit, recover outstanding amounts, and enforce personal guarantees where applicable;
  • to communicate with you about your account, orders, products, pricing, and our services;
  • to send trade and marketing communications where you have subscribed or where permitted by law;
  • to analyse and improve the Website, our products, and our services;
  • to maintain the security of the Website and our systems and to detect and prevent fraud;
  • to comply with our legal obligations, including under tax, food safety, work health and safety, and accounting laws; and

5. Credit-related information

Where you apply for a credit account, or provide a personal guarantee in support of a credit account, we may collect, use, and disclose credit information and credit eligibility information in accordance with the Privacy Act and the Privacy (Credit Reporting) Code.

This may include:

  • obtaining a credit report or other information about an individual or business from a credit reporting body;
  • using that information to assess an application for credit or a personal guarantee;
  • disclosing information to a credit reporting body, including information about overdue payments where permitted by law; and
  • exchanging information with trade referees you nominate.

If we obtain credit-related information about an individual, we will handle it consistently with the Privacy Act. You can contact us using the details in section 12 for more information about how we handle credit information.

6. Direct marketing

We may send trade and marketing communications about our products, pricing, and services to the businesses and contacts we deal with, where you have subscribed or where otherwise permitted by law. Every marketing email includes an unsubscribe link, and you can opt out at any time by using that link or by contacting us using the details in section 12. Once you opt out, we will stop sending marketing communications, although we may still send you communications necessary to administer your account and orders.

7. Who we disclose personal information to

We disclose personal information to third parties only as needed to operate our business and supply our products and services. These recipients include:

Shopify Inc. and its affiliates (including Shopify International Limited): our website platform provider, which hosts the Website. Shopify may store data in Canada, the United States, Ireland, and other locations.

Payment providers (including Stripe and PayPal): where payment is made by card through a payment link or invoice. These providers handle card details directly under their own privacy and security standards.

Email marketing platform (such as Klaviyo or Mailchimp): to send trade updates and marketing communications and to manage subscription preferences.

Analytics providers (including Google Analytics 4): to measure Website performance and understand how visitors use the Website.

Credit reporting bodies and trade referees: in connection with credit account applications and credit management, as described in section 5.

Logistics and delivery partners: to deliver orders to wholesale customers.

Professional advisers and service providers: including our accountants, auditors, lawyers, debt recovery agents, insurers, and IT and cybersecurity providers, where reasonably necessary.

Government, regulatory, and law enforcement bodies: where required or authorised by law, court order, or to protect our legal rights.

Acquirers and successors: if we sell or restructure all or part of our business, personal information may be transferred to the buyer or successor entity, subject to the same protections set out in this policy.

We require our service providers to handle personal information in accordance with applicable privacy laws and only for the purposes for which we engage them.

8. Cookies and similar technologies

The Website uses cookies and similar technologies to operate and secure the Website, remember preferences, and understand how the Website is used.

Strictly necessary cookies are required for the Website to function.

Analytics cookies (Google Analytics 4) help us understand how visitors use the Website so we can improve it.

9. Overseas disclosure

Some of the third parties listed in section 7 are located outside Australia or store data overseas. In particular, Shopify primarily stores data in Canada, the United States, and Ireland; Stripe and PayPal store data in the United States and other jurisdictions where they operate; Google stores data in the United States and other countries; and Klaviyo and Mailchimp store data in the United States.

When we disclose personal information overseas, we take reasonable steps to ensure the recipient handles the information consistently with the Australian Privacy Principles, including through our contractual arrangements with those providers.

10. Data security and retention

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. These steps include using reputable platform and payment providers that implement industry-standard security, restricting staff access to personal information on a need-to-know basis, and maintaining administrative and technical safeguards over our systems.

No system is completely secure. Where you hold account login details, you are responsible for keeping them confidential and notifying us promptly of any suspected unauthorised use.

We retain personal information only for as long as we need it for the purposes set out in this policy, or for as long as required by law. For example, we retain transaction, tax, and account records for at least seven years to meet our obligations under Australian law. Credit-related information is retained for the periods permitted under the Privacy Act and the Privacy (Credit Reporting) Code. Where personal information is no longer needed, we take reasonable steps to delete or de-identify it.

Under the Privacy Act, you have the right to:

Access the personal information we hold about you. We will provide access in accordance with the Privacy Act, generally within 30 days, and may charge a reasonable fee for retrieving and providing the information.

Correct personal information that is inaccurate, out of date, incomplete, irrelevant, or misleading.

Withdraw consent to direct marketing at any time, by using the unsubscribe link in any marketing email or by contacting us.

Make a complaint about how we have handled personal information (see section 12).
